Tree presevation order need urgently please

I am the leaseholder for the property of 35a diby crescent N4 2HS. I have an elderflower tree in my front garden and I have been told the freeholder is going to cut the tree down, I have not been formally advised of this. I live in a conservation area and this tree is habited by blue tits and other birds such as wood pigeon. it is a food source for these birds and birds have been nesting in this tree for the last 3 years. they are currently building their nests. I do not want this tree cut down, it reduces polution and helps the birds.
Dear Resident, thank you for contacting Hackney Council my name is Leif Mortensen and I am the Senior Landscape & Tree officer working in the Planning Department. Elderberry are considered to be a shrub, and tho it can sometime become quite large- this is something we would not seek to protect for the reasons mentioned. The freeholder has to notify us by writing to Planning@Hackney.gov.uk to notify us about the removal- works to trees / bushes must not disturb nesting birds and should be done outside nesting season. (The 'Bird Nesting Season' is officially from February until August (Natural England) and it is recommended that vegetation works (tree or hedge cutting) or site clearance should be done outside of the nesting season.
